TERMS AND CONDITIONS OF USE OF THE E-BIKE CHARGING SERVICE

1. Description of the E-bike charging service

The charging service for E-bikes (hereinafter "Service") allows users of Duferco Energia S.p.A. (hereinafter the "Manager") the use of the Bike-boxes for unattended parking and / or the recharging of pedal-assisted bicycles and the use of the Wall-boxes for the recharging of pedal-assisted bicycles (henceforth the Means).

2. Commitments of the User

The user of the Service (hereinafter "User") undertakes and undertakes to comply with the following requirements:

  • access the Service only after verifying that you are correctly enabled for the Operator's services;
  • use recharging sockets compliant with current regulations;
  • Do not tamper with any part of the technological systems (by way of example but not limited to the opening system, recharging system, etc.) and use the Service exclusively for recharging pedal-assisted bicycles;
  • Do not allow unauthorized persons to use the Bike-boxes and / or Wall-boxes or access the area where they are placed;
  • Do not dirty the structures and / or leave waste of any kind inside the Bike-Box or in the immediate vicinity of it;
  • do not use the Bike-boxes and / or Wall-boxes beyond the allowed time, as specified below;
  • do not use the Bike-boxes and / or the Wall-boxes for purposes other than those listed above.

With particular reference to Bike-boxes:

  • park the vehicle inside the Bike-boxes, securing it correctly to the structure and using only the special trolleys in order to position it safely;
  • properly close the access door of the Bike-boxes after having parked the vehicle and, if necessary, connected it to the recharging socket;
  • do not deposit any object other than the vehicle in the Bike-boxes.

3. Terms of Service

The User is authorized to use the Service for a maximum period of 10 days.

Starting from the second day of use of the Service, a bike-box occupancy rate will be applied regardless of the hours of actual use. The rates for use (e.g. per session, hourly) are shown and always available in the D-Mobility App and on the website mobility.dufercoenergia.com

Once the aforementioned term of 10 days has elapsed, the Manager, also by means of personnel appointed by it, will be authorized to forcefully remove the Vehicle.

The Vehicle will be held in custody by the Manager for a maximum period of 10 days within which it can be collected by the User, with an identity document and upon payment of the removal and storage costs.

Once the term referred to in the previous point has elapsed without the User having collected it, the latter will lose all rights in the Vehicle and the Manager may proceed, at its discretion, with the sale and / or destruction and / or retention of the same.

4. Liability

The Manager reserves the right to request compensation from the User for any damage deriving from improper use that does not comply with the specified methods of the Service.

The User agrees to indemnify and hold harmless the Manager from any dispute or compensation for charges or damages that, directly or indirectly, may arise from the same in the context of the use of the Service and which depend on the fact or behavior of the User.

In providing the Service, the Manager will be liable exclusively for any direct damage caused to the Vehicle, and attributable to the Manager itself, for technical problems up to a limit of € 5,000.

In particular, the Manager will not be responsible for:

  • for damage caused to the Vehicle by third parties during the use of the Service;
  • for damage caused by the User to third parties;
  • in case of theft, deterioration and / or total or partial destruction of the Vehicle deposited by the User in the Bike-boxes.
